Terms of Service

Welcome to Homi. These Terms of Service ("Terms") govern your access to and use of the Homi mobile application (the "App") provided by Homi ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Acceptance of Terms

By creating an account or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Eligibility

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the App. By using the App, you represent and warrant that you meet this eligibility requirement.

3. Account Registration

To access certain features, you may need to create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information.
  • Keep your login credentials confidential and secure.
  • Notify us immediately of any unauthorized use of your account.

You are responsible for all activities that occur under your account.

4. Use of the App

4.1 License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes in accordance with these Terms.

4.2 Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
  • Modify, adapt, translate, or create derivative works based on the App.
  • Remove, alter, or obscure any proprietary notices or labels on the App.
  • Use the App to transmit any viruses, malware, or other harmful code.
  • Attempt to gain unauthorized access to our systems, servers, or networks.
  • Use automated tools, bots, or scrapers to access or interact with the App.
  • Interfere with or disrupt the integrity or performance of the App.

4.3 User Content

You retain ownership of all data and content you enter into the App ("User Content"), including but not limited to bills, inventory items, expenses, income records, tasks, and scanned documents. You grant us a limited license to process, store, and display your User Content solely for the purpose of providing and improving the App's services.

5. Subscriptions and Payments

5.1 Free and Premium Tiers

Homi offers both free and premium subscription tiers. The free tier includes advertisements and limited access to certain features. The premium tier provides an ad-free experience and access to all features.

5.2 Billing

Premium subscriptions are billed through Apple's App Store. By subscribing, you agree to the pricing and payment terms presented at the time of purchase. Subscription fees are charged in advance on a recurring basis (monthly or annually, depending on your chosen plan).

5.3 Auto-Renewal

Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. You can manage your subscription and turn off auto-renewal in your Apple ID account settings.

5.4 Refunds

All purchases are processed through the Apple App Store. Refund requests are subject to Apple's refund policies. We do not directly process refunds for App Store purchases.

5.5 Price Changes

We reserve the right to change subscription prices at any time. Price changes will be communicated in advance and will take effect at the start of your next billing period.

6. AI-Powered Features

Homi includes AI-powered features such as recipe suggestions, spending forecasts, and financial insights. You acknowledge and agree that:

  • AI-generated content (recipes, forecasts, suggestions) is provided for informational purposes only and should not be considered professional advice.
  • AI suggestions may not always be accurate, complete, or suitable for your specific situation.
  • You are solely responsible for verifying the accuracy and safety of AI-generated recipes, especially regarding food allergies, dietary restrictions, and food safety.
  • We are not liable for any adverse outcomes resulting from reliance on AI-generated content.

7. Scanning Features

The App's scanning features (receipt scanning, barcode scanning, bill scanning) use optical character recognition (OCR) and image processing technologies. You acknowledge that:

  • Scanning results may not always be 100% accurate.
  • You are responsible for reviewing and verifying all scanned data before relying on it.
  • We are not liable for any errors or inaccuracies in scanned data.

8. Intellectual Property

The App, including its design, features, code, content, logos, and trademarks, is owned by us and is protected by intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the App beyond the limited license described in Section 4.1.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The App will be uninterrupted, timely, secure, or error-free.
  • The results obtained from the App will be accurate or reliable.
  • Any errors in the App will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) the App.
  • Any content, data, or functionality obtained from the App.
  • Unauthorized access to or alteration of your transmissions or data.
  • Any third-party conduct or content on the App.

Our total aggregate liability for any claims arising from or relating to these Terms or the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Homi and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the App, your User Content, or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination:

  • Your license to use the App will immediately cease.
  • You must stop all use of the App and delete it from your device.
  • We may delete your account and associated data in accordance with our Privacy Policy.

You may terminate your account at any time through the App's settings or by contacting us.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the competent courts of that jurisdiction.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by other means. Your continued use of the App after the changes take effect constitutes your acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Homi regarding your use of the App, and supersede any prior agreements or understandings.
